Terms of service
A line manager or buddy without a work inbox will soon be able to get their check-ins by WhatsApp instead of email.
These terms govern your organisation’s use of Accolgo. Plain English throughout; the short version is that Accolgo surfaces signals and suggests conversations, and every decision about a person stays with your organisation.
The service
Accolgo sends short check-ins to new starters, their managers and buddies for about the first six months of employment. Accolgo’s software combines the replies, without anyone reading the individual answers, and prompts the manager when a supportive conversation would help. It is an early-warning and manager-support tool. It is not a performance-management system, an HR record of truth, or a substitute for professional advice.
Your responsibilities
- Tell your people that Accolgo is in use and why, before their first check-in.
- Use the signals supportively. The service is built on the promise that answers lead to conversations, not verdicts.
- Keep your logins secure and remove members who leave.
- Only add people to the service who are genuinely part of your onboarding.
Intellectual property
Accolgo, including its software, question sets, scoring methods, documentation and branding, is owned by us and protected by copyright and other intellectual property law. Using the service gives your organisation the right to use it as intended; it does not transfer any ownership to you. You must not copy, reverse engineer, decompile, or attempt to extract the underlying methods of the service, and must not use anything learned from the service to build or help build a competing product. Any feedback you give us about the service may be used by us without restriction or payment.
Our responsibilities
- Run the service with reasonable skill and care.
- Process personal information only as the operator agreement allows.
- Analyse the check-in answers to show how each new starter seems to be settling.
- Accolgo’s colour, reasons and suggested next step are there to prompt a supportive conversation, not to judge anyone’s performance.
- Tell you without undue delay about any security compromise affecting your information, so you can meet your POPIA obligations.
Anonymised aggregates
We compute anonymised, aggregated statistics across the platform (for example, typical response rates and how quickly signals are actioned) to run and improve the service and to show customers how their onboarding compares. These never identify an organisation or a person, and are suppressed where numbers are small enough to risk identification.
Liability and the sensible limits
Accolgo is designed to a defensible professional standard, not as a guarantee. We do not accept liability for employment decisions your organisation makes.
We are not liable for any indirect or consequential loss, or for any loss of profit, revenue, goodwill or data, however it arises.
Our total liability to your organisation under or in connection with these terms, whether in contract, in tort (including negligence) or otherwise, is limited to one month's fees: the fees payable by your organisation for one month of its plan at the time of the event that gave rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded.
Governing law
These terms are governed by the laws of the Republic of South Africa, including the Protection of Personal Information Act (POPIA), the Electronic Communications and Transactions Act (ECTA) and, where it applies, the Consumer Protection Act (CPA). Any dispute is subject to the jurisdiction of the South African courts. Handling of personal information is set out in the privacy notice and the operator agreement.
Plans and billing
Each plan covers a number of new starters added to Accolgo in a plan year. Your first plan year starts when your subscription starts, and each plan year after that starts on its anniversary. New starters added during your free trial count towards your first plan year. A new starter counts from the moment they are added, and still counts after they leave or are removed. Changing plan, up or down, does not reset the count.
You can move at any time from your plan page to a bigger plan; that change starts from your next monthly bill. A smaller plan can be asked for up to two days before your anniversary, and it takes effect only at your yearly renewal, from your anniversary bill, and we do not move you to a smaller plan before then.
Every plan change, whether you make it or we do, is charged from your next monthly bill. We do not charge extra for the part of a month you have already paid for, and we do not refund any payment already made because of a plan change.
We will tell you when you reach 80% and 100% of your plan. Going over your plan never stops you adding a new starter. If you go over it, we will move you to the smallest plan that covers your number, no sooner than 7 days after telling you. Above 150 new starters in a plan year we will not move you automatically, and will ask you to agree an Enterprise plan with us.
On each anniversary, from the bill on that day, we will set your plan for the coming plan year from the number of new starters added in the plan year just ended, as counted the day before your anniversary, up or down, and will tell you beforehand, usually 14 days before. If you have chosen a smaller plan for the coming plan year, we use your choice instead, and move you up again only if you go over its number in that year.
Ending the agreement
You can ask us to close your account at any time, and to give you a copy of your information. Automatic deletion is not switched on yet, so on closure we keep your information until we delete it, and we delete it by hand when you ask, subject to legal holds. The retention policy has the dated update.
